Terms of Engagement

Scope of Services

Our services are limited to the services identified in the applicable quotation, invoice or written scope of work accepted by the Client.

Services can include application preparation, document review, submission, administration, coordination and reasonable follow-up with the relevant parties and Indonesian government authorities.

A service does not include work that is not expressly identified in the applicable quotation, invoice or written scope of work.

Client Information and Documents

The Client must provide complete, accurate, current and truthful information and documents.

The Client must not provide false, altered, misleading, incomplete or fraudulent information or documents.

The Client is responsible for checking information supplied for an application before submission when we request the Client to do so.

Guarantor / Sponsor

The Client acknowledges that a guarantor or sponsor (Penjamin) can have legal and administrative obligations arising from the Client's immigration status.

The Client must promptly provide information reasonably required for the guarantor/sponsor to comply with those obligations.

The Client must not withhold a material fact that could affect an application, visa, stay permit, guarantor/sponsor or compliance with Indonesian immigration requirements.

Reliance on Client Information

We may rely on information and documents supplied by the Client without independently verifying their authenticity or accuracy unless verification forms part of the agreed service.

We are not responsible for an error, rejection, delay, cancellation, immigration consequence, government action or other loss caused by inaccurate, incomplete, outdated, misleading, fraudulent or undisclosed information supplied or withheld by the Client or another person acting for the Client.

Client Indemnity

To the extent permitted by applicable law, the Client indemnifies PT Kapan Kita Bersama, its personnel, agents and the applicable guarantor/sponsor against claims, losses, liabilities, penalties, costs and reasonable expenses arising from:

1. false, fraudulent, inaccurate, incomplete or misleading information or documents supplied by or on behalf of the Client;
2. a material fact or change that the Client failed to disclose promptly;
3. a misrepresentation made by or on behalf of the Client; or
4. the Client's breach of Indonesian immigration requirements or these Terms.

This indemnity does not apply to loss to the extent caused by our fraud, wilful misconduct or liability that cannot lawfully be excluded.

Government Decisions and Processing

Payment for a service does not guarantee approval, issuance, processing within a particular period or any particular decision by an Indonesian government authority.

Government requirements, fees, procedures, systems and processing times can change.

Additional government requirements or costs that arise after acceptance of a quotation are outside the quoted service fee unless the quotation expressly states otherwise.

Client Cooperation

The Client must provide requested information and documents within a reasonable time.

The Client must complete any required personal attendance, biometrics, interview, payment, signature or other government procedure.

A delay caused by the Client can affect the application timetable or the Client's immigration status.

Fees and Third-Party Costs

A quotation covers only the services and costs expressly identified in it.

Additional government charges, penalties, translations, legalisation, courier charges, travel, third-party professional fees or additional work outside the quoted scope can be charged separately where applicable.

Suspension or Termination

We may suspend or terminate a service if we reasonably believe that information or documents supplied are false, misleading, fraudulent, materially incomplete or inconsistent.

We may also suspend or terminate a service if continuing the service could cause a breach of applicable law or immigration requirements.

Client Confirmation

By accepting a quotation or invoice, or by making payment, the Client confirms that:

• information and documents supplied are true, accurate, complete and current;
• the Client understands the continuing obligation to report relevant changes;
• the Client authorises us to provide necessary information and documents to the guarantor/sponsor, relevant service providers and Indonesian government authorities for the agreed service; and
• the Client accepts these Terms of Engagement.
